  • Nội dung thể hiện: Trên bản đồ quy hoạch sử dụng đất đai phải thể hiện các nội dung sau:
  • Các yếu tố địa lý chủ yếu như điểm cao khống chế, mạng lưới thủy văn, mạng lưới đường xá, ranh giới hành chính.
  • Hiện trạng các loại đất cụ thể theo từng mục đích sử dụng.
  • Các loại đất chính theo quy hoạch bao gồm: đất nông nghiệp, đất lâm nghiệp, đất khu dân cư nông thôn, đất đô thị, đất chuyên dùng và đất chưa sử dụng. Thể hiện chi tiết, cụ thể đối với các dự án và công trình như: đất xây dựng trong các khu dân cư (các công trình phúc lợi công cộng), đất dành cho công trường xí nghiệp khai thác độc lập, đất xây dựng giao thông, thủy lợi, đất dành cho du lịch và vùng bảo vệ tự nhiên...
  • Vẽ và thể hiện trên bản đồ: Chuyển vẽ lên bản đồ quy hoạch sử dụng đất đai diện tích, phạm vi, vị trí quy hoạch sử dụng các loại đất (đưa vào bản đồ phần diện tích tăng, giảm sau khi so sánh các loại sử dụng đất ở thời điểm hiện trạng và theo quy hoạch).

Các nội dung thể hiện trên bản đồ quy hoạch sử dụng đất đai (như: ranh giới, loại đất, biểu đồ ký hiệu, màu sắc, kiểu chữ và bố cục bản đồ...) thực hiện theo đúng hướng dẫn của Tổng Cục Địa Chính (Tập ký hiệu bản đồ hiện trạng và quy hoạch sử dụng đất đai ban hành kèm theo quyết định số 407 QĐ/ĐC ngày 07/06/1995 của TCĐC).

Cần lưu ý: Khi ranh giới sử dụng các loại đất giữa hiện trạng và quy hoạch không trùng khớp nhau, trên bản đồ quy hoạch sẽ dùng đường nối đứt đoạn để biểu thị các ranh giới quy hoạch. Khi quy hoạch chuyển mục đích sử dụng của một mảnh đất nào đó, vẫn giữ lại ranh giới theo hiện trạng mảnh nhằm phản ánh tình hình thay đổi của mảnh đất đó theo quy hoạch so với hiện trạng.

Điều 20. Bản đồ hiện trạng sử dụng đất và bản đồ quy hoạch sử dụng đất

1. Bản đồ hiện trạng sử dụng đất được lập năm năm một lần gắn với việc kiểm kê đất đai quy định tại Điều 53 của Luật này để phục vụ cho việc quản lý quy hoạch, kế hoạch sử dụng đất.

2. Bản đồ quy hoạch sử dụng đất được lập mười năm một lần gắn với kỳ quy hoạch sử dụng đất quy định tại Điều 24 của Luật này.

Bản đồ quy hoạch sử dụng đất của xã, phường, thị trấn được lập trên bản đồ địa chính gọi là bản đồ quy hoạch sử dụng đất chi tiết.

3. Bộ Tài nguyên và Môi trường chỉ đạo việc khảo sát, đo đạc, lập và quản lý bản đồ hiện trạng sử dụng đất, bản đồ quy hoạch sử dụng đất trong phạm vi cả nước và tổ chức thực hiện việc lập bản đồ hiện trạng sử dụng đất, bản đồ quy hoạch sử dụng đất của cả nước.

4. Uỷ ban nhân dân có trách nhiệm thực hiện việc kiểm kê đất đai ở địa phương nào thì tổ chức thực hiện việc lập bản đồ hiện trạng sử dụng đất của địa phương đó.
